Tenants and Reasonable Accommodations
One of our longtime tenants, CS, is an old man who uses a walker. He lives at an apartment complex that does not have parking spaces drawn on the parking area. It does not have "assigned" parking spaces. Heretofore, this has not been a problem because people mostly park in front of their own doors and don't park in front of OTHER people's doors.
So CS called the office with a laundry list of complaints that necessitated a visit. I went to visit.
When I get there, outside of CS's apartment is a full sized pickup truck parked clean up against the building. It is not CS's vehicle. (He doesn't drive anymore but his wife does. They still call it his car because of marriage reasons I guess. Male pride? I dunno.)
I go to the door and CS invites me in. His laundry list of complaints can be boiled down to "They are parking in my space." with a side order of "The truck is unsightly and there are beer cans in the bed plus also assorted redneck trash." He is quite upset, with the best upsetitude that can be mustered by a very dignified but somewhat tottery old dude with six teeth missing.
The pickup belongs to friends of one of the other tenants. There'd been a birthday party for their two year old son and the guests (who are young, as are the parents) got to drinking, politely and reasonably quietly. To avoid getting a DUI, one of the guests slept the night in his ratty-ass pickup truck what he had parked next to CS's apartment. Bee-Tee-Dubs, if you're caught asleep and drunk in your car by the cops, it's still a DUI. It shows "intent to drive" and shit, even if you don't have the keys in the ignition, the hood is cool, and you never even attempted to start the vehicle. Be ye warned. However, parked well off the road on private property where the cops cannot SEE you sleeping in your vehicle, you will probably not get tagged because they can't see you doing this. In a bar parking lot or along the street? You're going to get nailed.
I am all "Mr. CS*, you know we do not have assigned parking spaces in this complex," and I held up a hand to stay his coming objection while I continued, smiling broadly "But if you are requesting an accommodation for your mobility limitations, then I am REQUIRED BY LAW to provide you with a free, personal parking space right next to your door and nobody else can say Boo to it. Are you (air quotes) requesting an accommodation (air quotes)?" And Mr. CS smiled back at me and said "Yes, indeed. I am requesting an accommodation." We painted the lines and his RESERVED space on the parking lot that afternoon.
*Though we are on good terms, Mr. CS is from the era where it totally means something to him for his white landlord to call him Mr. and it costs me absolutely NOTHING to give this to him.
